Under Maryland law, the officer is supposed to advise you of this. If he fails to, you may be able to have the results of the test thrown out.
Administration of the Test
Maryland requires that officers follow strict regulations when administering the breathalyzer test. If you believe the machine wasn’t calibrated properly, or the officer or technician conducting the test did so in an incorrect manner, the result may be thrown out if you can prove that was the case.
